These Terms & Conditions ("Terms") govern your use of easykwenasolutions.co.za and the services offered by Easy Kwena Solutions (Pty) Ltd ("EKS"). By accessing the site or engaging EKS for services, you agree to be bound by these Terms. They are governed by the laws of the Republic of South Africa, including the Electronic Communications and Transactions Act 25 of 2002 (ECTA), the Consumer Protection Act 68 of 2008 (CPA), and POPIA.

2 Permitted use of this site
You may view the site and submit enquiries via the contact and newsletter forms for lawful purposes only. You may not scrape, copy or republish the content (other than ordinary browser caching), nor introduce any virus, trojan, or malicious code to the site.

All copyright, trademarks (including the EKS wordmark and the E&S monogram), photographs and text on this site are owned by or licensed to EKS, and are protected under the Copyright Act 98 of 1978 and applicable South African law. No licence is granted to use any of this content without our written permission.
4 Engagements & services
Services described on this site (software development, geographic information systems, earth moving, logistics, fleet and chrome supply) are made available subject to a separate, signed engagement letter or Statement of Work between EKS and the client. Pricing, deliverables, timelines and warranties are agreed in those documents; nothing on this site constitutes a binding offer.
5 Consumer Protection Act
Where the CPA applies to a transaction, your rights under the Act are not limited or excluded by these Terms. Limitations of liability set out below apply only to the extent permitted by the CPA.
6 Limitation of liability
To the maximum extent permitted by law, EKS is not liable for indirect, consequential, incidental or special damages arising out of or in connection with your use of this site, including loss of profit, loss of business, loss of data or loss of goodwill. EKS does not warrant that the site will be uninterrupted or error-free.
7 Third-party links
The site may contain links to third-party websites (e.g. Mining Weekly, Engineering News, Google Maps, social media platforms). EKS does not endorse and is not responsible for the content, privacy practices or availability of those sites.
8 Termination
EKS reserves the right to suspend or terminate access to the site, or to remove any submitted enquiry, at any time and without notice, where we reasonably believe the Terms have been breached.

10 Governing law & jurisdiction
These Terms are governed by South African law. Any dispute arising out of or in connection with them is subject to the exclusive jurisdiction of the Magistrate's Court or High Court of South Africa sitting in Johannesburg, Gauteng.
