This Privacy Policy describes how Easy Kwena Solutions (Pty) Ltd ("EKS", "we", "us") processes personal information about visitors to easykwenasolutions.co.za and clients we engage with directly. We comply with the Protection of Personal Information Act, 4 of 2013 (POPIA) and, where applicable, the Promotion of Access to Information Act, 2 of 2000 (PAIA).

1   Responsible party

2   Personal information we collect

When you submit our contact form, subscribe to the newsletter, or engage us for a project, we collect the information you choose to provide - typically name, organisation, role, contact details and a description of your project or enquiry. We do not collect more than is necessary for the purpose for which it is processed.

3   Purpose of processing

We process personal information to respond to your enquiries, deliver agreed work under our engagement letters, send the newsletter you subscribed to, and improve the relevance of what we publish. We do not sell personal information and we do not use it for behavioural advertising.

4   Lawful basis

We rely on one or more of the lawful bases set out in section 11 of POPIA - consent (newsletter), the performance of a contract or steps to enter into one (project work), our legitimate interests (responding to enquiries), and compliance with legal obligations (tax, accounting and other regulatory requirements).

5   Cookies and analytics

6   Sharing & cross-border transfer

We share personal information with a small set of sub-operators strictly to operate the site and run client engagements - hosting, email delivery and analytics. Where these providers are located outside South Africa, we ensure adequate protection in line with section 72 of POPIA, including reliance on standard contractual clauses where applicable.

7   Data retention

We retain personal information only for as long as is necessary to fulfil the purpose for which it was collected, or as required by law (e.g. tax records under the Tax Administration Act, retained for 5 years). Newsletter records are kept until you unsubscribe; enquiries are typically purged 24 months after the last contact.

8   Your rights as a data subject

Subject to POPIA, you have the right to: be notified that personal information about you is being collected; access your personal information held by us; request correction or deletion of inaccurate, irrelevant or excessive personal information; object to processing; lodge a complaint to the Information Regulator.
